By accessing or using Quali.chat, you agree to comply with these Terms of Use, as well as our Privacy Policy and any additional terms and conditions that may apply to specific sections of the platform or to products and Service available through the platform.

Quali.chat reserves the right to change, modify, add, or remove portions of these Terms of Use at any time. We will notify you of any significant changes by posting the updated terms on the platform or through other communication methods. Your continued use of Quali.chat after any changes to these terms signifies your acceptance of the updated terms.
POSSIBLE CHANGES OF THE PROVIDED SERVICE
We are always trying to improve our Service, so they may change over time. We may suspend or discontinue any part of the Service, or we may introduce new features or impose limits on certain features or restrict access to parts or all of the Service. We’ll try to give you notice when we make a material change to the Service that would adversely affect you, but this is not always practical. We reserve the right to remove any Content from the Service at any time, for any reason (including, but not limited to, if someone alleges you contributed that Content in violation of these Terms), in our sole discretion, and without notice.
USER ACCOUNTS AND REGISTRATION
To access the Service and features of Quali.chat, you are required to register for an account. You agree to:

When an Ethereum wallet is connected to the user’s profile, the display name of a user is set to the ENS name owned by the address, and it CANNOT be changed manually by the User.
USER ID AUTHETICATION
I. ERC-20 Authentication
Quali.chat requires the usage of the ERC-20 token system to function properly, hence the requirement for the User to provide Quali.chat with an Ethereum wallet in order to register for an account.
Users of Quali.chat are automatically added or removed to chat rooms based on the ERC-20 tokens owned.
II. Username and Password Authentication*
Users of Quali.chat may authenticate themselves and register for an account by creating and using username and password credentials.
Users which choose to authenticate via username and password would not be able to experience all functionalities of the Service of Quali.chat, unless they provide and connect to their profile an Ethereum (or other crypto-token sustained by Quali.chat) wallet. Only then could users enjoy the full range of Quali.chat’s functionalities.
Users can search and access public token gated rooms but cannot come in contact (e.g. write) in any way with the members of the rooms if the token associated to the room is not present in the user’s wallet or there is no wallet connected to user’s profile.
Quali.chat uses its own or third party provided tool based on an open-source code for authenticating users’ identity through their Ethereum wallets.

Children’s Online Privacy Protection Act
The Children’s Online Privacy Protection Act (“COPPA”) requires that online service providers obtain parental consent before they knowingly collect personally identifiable information online from children who are under 16 years of age. We do not knowingly collect or solicit personally identifiable information from children under 16 years of age; if you are a child under 16 years of age, please do not attempt to register for or otherwise use the Service or send us any personal information. If we learn we have collected personal information from a child under 16 years of age, we will delete that information as quickly as possible. If you believe that a child under 16 years of age may have provided us personal information, please contact us at support@quali.chat.com.

USERCONDUCT
You represent and warrant that you are an individual of legal age to form a binding contract. If you are under the age of 16, please do not use the Service of Quali.chat.
You will only use the Service for your own internal, personal, non-commercial use, and not on behalf of or for the benefit of any third party, and only in a manner that complies with all laws that apply to you. If your use of the Service is prohibited by applicable laws, then you are not authorized to use the Service.
We can’t and won’t be responsible for your using the Service in a way that breaks the law. You agree to use Quali.chat in a manner that is lawful, respectful, and consistent with community standards. You agree not to:

You represent, warrant, and agree that you will not provide or contribute anything, including any Content (as that term is defined below), to the Service, or otherwise use or interact with the Service, in a manner that:

We can’t guarantee the identity of any users with whom you interact in using the Service and are not responsible for which users gain access to the Service.

Quali.chat has no control over, and assumes no responsibility for, the content, accuracy, privacy policies, or practices of or opinions expressed in any third-party websites or by any third party that you interact with through the Service. In addition, Quali.chat will not and cannot monitor, verify, censor or edit the content of any third-party site or service. By using the Service, you release and hold us harmless from any and all liability arising from your use of any third-party website or service.
Your interactions with organizations and/or individuals found on or through the Service, including payment and delivery of goods or Service, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such organizations and/or individuals. You should make whatever investigation you feel necessary or appropriate before proceeding with any online or offline transaction with any of these third parties. You agree that Quali.chat shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings.
If there is a dispute between participants on this site or Service, or between users and any third party, you agree that Quali.chat is under no obligation to become involved. In the event that you have a dispute with one or more other users, you release Quali.chat, its directors, officers, employees, agents, and successors from claims, demands, and damages of every kind or nature, known or unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in any way related to such disputes and/or our Service. You shall and hereby do waive California Civil Code Section 1542 or any similar law of any jurisdiction, which says in substance: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”

SAFETY OF ACCOUNT INFORMATION
If you choose, or you are provided with, a password, encryption keys, or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party and you must store it securely. You should make use of cross-signed device verification for devices accessing your account and minimise the number of verified devices by periodically reviewing and removing unused, lost or stolen devices. We have the right to deactivate and/or delete your account and password, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these Terms of Use. If you know, or suspect that anyone other than you knows, your password or encryption key, please contact us at support@quali.chat.com.
APPLICABLE LAW, PLACE OF JURISDICTION
Where and when applicable, given that it does not contradict to any law, regulation or statutory provision, the law of the Principality of Liechtenstein shall apply to this terms of use, as to all our other terms and policies.
Place of jurisdiction for disputes arising under or in connection with this terms, including but not limited to its subject matter, formation, disputes on the validity and enforceability of its clauses, including any non-contractual disputes or claims is Vaduz, Liechtenstein.
However, Quali.chat reserves the right to bring an action before any other competent court of jurisdiction.
COST OF USING THE SERVICE
The Service is currently free, but we reserve the right to charge for the Service in the future.
We will notify you before the Service begin carrying a fee, and if you wish to continue using the Service, you must pay all applicable fees for the Service.
TERMINATION AND END OF USE FOR THE SERVICE
You are free to end your use of the Service at any time.
Quali.chat is also free to terminate (or suspend access to) your use of the Service for any reason in our discretion, including your breach of these Terms. Quali.chat has the sole right to decide whether you are in violation of any of the restrictions set forth in these Terms.
Provisions that, by their nature, should survive termination of these Terms shall survive termination. By way of example, all of the following will survive termination: any obligation you have to indemnify us, any limitations on our liability, any terms regarding ownership or intellectual property rights, and terms regarding disputes between us.
Quali.chat reserves the right to suspend or terminate your account and access to the platform at any time, with or without notice, for any reason, including but not limited to, violation of these Terms of Use or engaging in prohibited conduct.
