Welcome to Quali.chat. Your privacy is critically important to us. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our application. Please read this policy carefully to understand our views and practices regarding your personal data and how we will treat it.

What this Privacy Policy covers

This Privacy Policy covers how we treat Personal Data that we gather when you access or use our Service. “Personal Data” means any information that identifies or relates to a particular individual and also includes information referred to as “personally identifiable information” or “personal information” under applicable data privacy laws, rules or regulations. This Privacy Policy does not cover the practices of companies we don’t own or control or people we don’t manage.

1. Information we Collect

    • Profile Data

    • Parties you authorize, access or authenticate with

Example of Personal Data we collect:

    • Ethereum address;
    • ENS domain associated with Ethereum address;
    • When authenticating via username and password: Username and password, email address, first and last name, avatar or user’s photo if they choose to use such for profile avatar/photo.

The sources from which we collect Personal Data are you, when you provide such information directly, and public records, i.e. publicly-viewable information on the Ethereum blockchain.

1.2. Usage Information

We collect information about your interactions with our application, such as:

    • Chat Messages (encrypted end-to-end for private messages)

    • Usage Logs (e.g., login times, feature usage). When you are signed in to your account we may track your usage of the site and associate that information with your account details. This data helps us understand how our users are using the application so that we can make improvements to the Service.

1.3. Device Information

We may collect information about the device you use to access Quali.chat, including:

    • Device Type

    • Operating System

    • IP Address

    • Device Identifier

We log the IP addresses of everyone who accesses Quali.chat. This data is used in order to mitigate abuse, debug operational issues, and monitor traffic patterns. Our logs are kept for the necessary period of time that we need to use the data for or until the collection of the information fulfills the purpose for its collection, as mentioned above. 

When using Quali.chat your visit to the service will be logged, alongside your device ID and agent. This allows us to understand usage patterns based on each platform. The mapping of this data is logged for 28 days – from this point on only aggregated data is kept, for operational and statistical purposes.

Quali.chat guarantees that we collect the information with no malicious intent and only for providing our users with the best experience possible.

1.4. Legal basis for processing of Personal Data

• We collect Personal Data under legitimate interest in order to support operational maintenance and to protect against malicious actions against our infrastructure. Furthermore for: 

    • Providing support and assistance for the Service. We use your information to operate, maintain, and provide you with the features and functionality of Quali.chat.

    • Improving the Service, including testing, research, internal analytics and product development. We analyze usage data to understand how users interact with Quali.chat and to enhance and improve our application. Analyze how you interact with notifications to enhance our Service.

    • Doing fraud protection, security and debugging. We use information to monitor and protect the security of our application, including detecting and preventing fraudulent activity.

    • We may use your information to send you updates, notifications, and other important information related to Quali.chat.

    • Deliver notifications. To send you timely and relevant push notifications.

    • Compliance of our contractual obligations.

• Meeting legal requirements and enforcing legal terms 

    • Fulfilling our legal obligations under applicable law, regulation, court order or other legal process, such as preventing, detecting and investigating security incidents and potentially illegal or prohibited activities. 

    • Protecting the rights, property or safety of you, us or another party. 

    • Responding to claims that any posting or other content violates third-party rights. 

    • Resolving disputes.

We will not collect additional Personal Data or use the Personal Data we collected for materially different, unrelated or incompatible purposes without providing you notice.

You have rights in relation to the personal data we hold about you.

Your rights under General Data Protection Regulation (EU) 2016/679 (GDPR) are:

3. How We Share Your Information

3.1. With Service Providers

We may share your information with third-party service providers who perform services on our behalf, such as hosting, technology and/or communication providers or otherwise help us provide the Service to you.

3.2. Parties you Authorize, Access or Authenticate with

These parties include third parties you choose to authorize, access or authenticate with through the Service.

3.3. For Legal Reasons

We may disclose your information if required to do so by law or in response to valid requests by public authorities. In exceptional circumstances, we may share information about you with a third party if we believe that sharing is reasonably necessary to

    • comply with any applicable law, regulation, legal process or governmental request,

    • protect the security or integrity of our service,

    • protect Quali.chat and our users from harm or illegal activities, or

    • respond to an emergency which we believe in good faith requires us to disclose information to assist in preventing the serious bodily harm of any person.

3.4. Business Transfers

All of your Personal Data that we collect may be transferred to a third party if we undergo a merger, acquisition, bankruptcy or other transaction in which that third party assumes control of our business (in whole or in part). Should one of these events occur, we will make reasonable efforts to notify you before your information becomes subject to different privacy and security policies and practices.

3.5. Data that is not Personal Data

We may create aggregated, de-identified or anonymized data from the Personal Data we collect, including by removing information that makes the data personally identifiable to a particular user. We may use such aggregated, de-identified or anonymized data and share it with third parties for our lawful business purposes, including to analyze, build and improve the Service and promote our business, provided that we will not share such data in a manner that could identify you.   

4. Personal Data Protection and access to Personal Data

4.1. Personal Data Protection

Quali.chat does NOT store Profile Data, except profile avatar/photo (optional) when users are authenticated through their Ethereum (or other crypto-token sustained by Quali.chat) wallet credentials. 

To safeguard the user’s Personal Data from unauthorized access, collection, use, disclosure, copying, modification, disposal and all similar risks, Quali.chat has put in place appropriate administrative, physical, security and technical measures from the point of collection to the point of destruction of such Personal Data.

It is your sole responsibility to keep your credentials and other sensitive information confidential. Actions taken using your credentials shall be deemed to be actions taken by you, with all consequences including service termination, civil and criminal penalties.

If you become aware of any unauthorised use of your account or any other breach of security, you must notify us immediately by sending an email to support@quali.chat . Users should keep their confidential information safe as strictly as possible.

You should be informed that no method of transmission over the world wide web or method of electronic storage is completely secure. However, Quali.chat strives to protect the security of user’s information and is constantly updating and modernizing its information security measures.

4.2. Access to or correction of Personal Data

You can request a copy of your information by emailing us at support@quali.chat.

4.3. Third-party access to Personal Data

Quali.chat Service is hosted on Synapse which is a Matrix homeserver developed by Element. Both take every precaution in keeping Personal Data as safe as possible. For reference: Matrix Privacy Policy and Element Privacy Policy. 

Nobody at Quali.chat, or any processors, is able to access encrypted data.

As Quali.chat uses external software for its applications, the users should be informed that the following notices may apply to them:

5. Data Security and Retention

We seek to protect your Personal Data from unauthorized access, use and disclosure using appropriate physical, technical, organizational and administrative security measures based on the type of Personal Data and how we are processing that data. Although we work to protect the security of your data that we hold in our records, please be aware that no method of transmitting data over the internet or storing data is completely secure. 

We retain Personal Data about you for as long as necessary to provide you with our Service. In some cases (ex. in case of termination of using the Service), we may retain Personal Data for longer, if doing so is necessary to comply with our legal obligations or resolve disputes, or is otherwise permitted or required by applicable law, rule or regulation. We may further retain information in an anonymous or aggregated form where that information would not identify you personally. 

All user data reside within the same dedicated cluster. We segment user data via software. We do our best to keep no unauthorized access to the data, but, we cannot guarantee that it is immune to a sophisticated attack.

6. Children’s Privacy

We never knowingly collect or maintain information through the Service provided, from those we know are under 16, and no part of Quali.chat is structured to attract anyone under 16. If you are under 16, please do not attempt to register for or otherwise use the Service or send us any Personal Data. If we learn we have collected Personal Data from a person under 16 years of age, we will delete that information as quickly as possible. If you believe that a person under 16 years of age may have provided Personal Data to us, please contact us at support@quali.chat.

7. Changes to This Privacy Policy

We are constantly trying to improve our Service, so we may need to change this Privacy Policy from time to time, but we will alert you to any such changes by placing a notice on our website, push notification on your mobile device, or by some other means. Please note that if you have opted not to receive push notifications from our application (or you do not use our mobile application) those legal notices will still govern your use of the Service, and you are still responsible for reading and understanding them. If you use the Service after any changes to the Privacy Policy have been posted, that means you agree to all of the changes. Use of information we collect is subject to the Privacy Policy in effect at the time such information is collected.

8. Tracking tools

The Service use cookies and similar technologies such as pixel tags, web beacons, clear GIFs and JavaScript (collectively, “Cookies”) to enable our servers to recognize your web browser, tell us how and when you visit and use our Service, analyze trends, learn about our user base and operate and improve our Service. 

We use the following types of Cookies: 

• Essential Cookies. 

• Functional Cookies. 

You can decide whether or not to accept Cookies through your internet browser’s settings. Most browsers have an option for turning off the Cookie feature, which will prevent your browser from accepting new Cookies, as well as (depending on the sophistication of your browser software) allow you to decide on acceptance of each new Cookie in a variety of ways.
